All the contents, materials and information (“the Contents”) contained in this website are compiled by Cooking Oil and Health Committee (COHC). COHC reserves the right to update or modify any of the Contents from time to time without prior notice. The Contents are for non-commercial use only. You are not allowed to distribute, modify, transmit, reproduce or revise any Contents without the prior written permission of COHC.

This website and the Contents are protected by copyright, trademark and other forms of proprietary rights. All rights, title and interests in and to this website and the Contents are owned by (or licensed to) COHC. Nothing contained in this website should be construed as granting a licence or right to use any trademarks displayed in or other intellectual property rights arising from this website without the written permission of the owner.

Use of this website will be subject to COHC Privacy Policy. You agree to be bound by COHC Privacy Policy, which will apply to all personal data provided by you as well as to personal data arising as a result of use of the web services.

You will on demand indemnify, hold harmless and defend COHC against all losses, damages, claims, actions, liabilities and costs (including legal costs) suffered or incurred as a result of your use of this website, including but not limited to any breach whatsoever of any or all of the above terms and conditions.

Governing Law and Jurisdiction
These Conditions of Use shall be governed and construed in accordance with laws of the Hong Kong Special Administrative Region of the PRC (“Hong Kong”) and you agree to submit to the exclusive jurisdiction of the Hong Kong courts.

PRIVACY POLICY

1. We, Cooking Oil and Health Committee, are committed to protecting your personal data.
2. Hong Kong legislation controls the collection, use and storage of personal information (“data”). This policy is being provided to individuals dealing with COHC in Hong Kong (“Relevant Persons”) from whom data have been and/or may in the future be collected.
3. This policy applies to all data submitted via the COHC Website. Relevant Persons may be asked to provide data when registering for membership on the COHC Website, participating in competition / lucky draw / game, receiving information, ordering products, filling out a survey, or involving in any other activities conducted via the COHC Website. The provision of data is voluntary and Relevant Persons are not required to provide more information than is necessary to participate in the COHC Website’s activities. If a Relevant Person does not want his/her data to be collected, please do not provide it to us. However, failure to supply such data may result in inability to set up an account, participate in relevant activities, or log in the membership area.
4. The purposes for which data relating to a Relevant Person may be used are as follows: –
i. the daily operation of COHC’s business and the COHC Website including but not limited to:
a. processing and evaluating the Relevant Persons’ applications and inquiries in respect of their membership and purchasing orders;
b. administering and providing services in relation to COHC;
c. invoicing and collecting payment; and
d. contacting the Relevant Persons for any of the above purposes;
ii. researching, supervising, analyzing, improving, designing, promoting and / or popularizing the COHC Website and / or any other facilities, services and / or products provided to any customers of COHC;
iii. facilitating communication amongst members and COHC, and encouraging members to feedback as to their expectation and needs of the COHC Website and COHC and of the facilities, services and / or products provided;
iv. notifying the redemption of gift / coupon for rewards points plan, and relevant arrangement for the redemption;
v. marketing services, products and other subjects (please see further details in paragraph (6) below);
vi. the enforcement of Relevant Persons’ obligations, including without limitation collection of amounts outstanding from Relevant Persons;
vii. complying with the obligations, requirements or arrangements for disclosing and using data that apply to COHC or that it is expected to comply according to:
a. any law binding or applying to it within or outside Hong Kong existing currently and in the future;
b. any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or industry bodies or associations existing currently and in the future;
viii. enabling an actual or proposed assignee of COHC, or participant or sub-participant of COHC’s rights in respect of the Relevant Person to evaluate the transaction intended to be the subject of the assignment, participation or sub-participation; and
ix. purposes relating thereto.
5. Data held by COHC relating to a Relevant Person will be kept confidential but COHC may provide such information to the following parties for the purposes set out in paragraph 4 above: –
i. any agent, contractor or third party service provider who provides marketing, promotional, administrative, management, telecommunications, computer, technology, legal, payment or clearing or other services to COHC in connection with the operation of its business (including promotion, gifts, lucky draw, game and other activities from time to time);
ii. any other person under a duty of confidentiality to COHC including a member of COHC which has undertaken to keep such information confidential;
iii. any person to whom COHC is under an obligation or otherwise required to make disclosure under the requirements of any law binding on or applying to COHC, or any disclosure under and for the purposes of any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or industry bodies or associations with which COHC are expected to comply;
iv. any actual or proposed assignee of COHC or participant or sub-participant or transferee of COHC’s rights in respect of the Relevant Person; and
a. any member of COHC; and
b. external service providers (including but not limited to mailing houses, telecommunication companies, telemarketing and direct sales agents, call centres, data processing companies and information technology companies) that COHC engages for the purposes set out in paragraph 4(v) above.
Such information may be transferred to a place outside Hong Kong.
6. USE OF DATA IN DIRECT MARKETING
COHC intends to use a Relevant Person’s data in direct marketing and COHC requires the Relevant Person’s consent (which includes an indication of no objection) for that purpose. In this connection, please note that:
i. the name and contact details of a Relevant Person held by COHC from time to time may be used by COHC in direct marketing;
ii. the following classes of services, products and subjects may be marketed: foods products, personal care products, finance, investment, insurance, banking and related services and products;
iii. the above services, products and subjects may be provided by COHC and/or any member of COHC.
If a Relevant Person does not wish COHC to use his/her data in direct marketing as described above, the Relevant Person may exercise his/her opt-out right by notifying COHC.

7. Under and in accordance with the terms of the Personal Data (Privacy) Ordinance (the “Ordinance”) and the Code of Practice on Consumer Credit Data, any Relevant Person has the right: –
i. to check whether COHC holds data about him and of access to such data;
ii. to require COHC to correct any data relating to him which is inaccurate; and
iii. to ascertain COHC’s policies and practices in relation to data and to be informed of the kind of personal data held by COHC.
8. In accordance with the terms of the Ordinance, COHC has the right to charge a reasonable fee for the processing of any data access request.
9. The person to whom requests for access to data or correction of data or for information regarding policies and kinds of data held are to be addressed is as follows: –

10. Nothing in this policy shall limit the rights of Relevant Persons under the Ordinance.
11. To help us to provide a better service to you, please ensure that your contact details including your home and office addresses, your telephone numbers (including your mobile telephone number), e-mail address and other details registered with us are up to date.
12. If you do not want to receive any direct marketing or follow up regarding products and special promotions from COHC, please notify us in writing or sending email to info@cohc.hk. No fee will be charged.
13. Your visiting to the COHC Website may trigger our use of cookies. Cookies used (if any) in any part of the COHC Website will not be deployed for collecting personally identifiable information. If cookies are deployed for collecting personally identifiable information in the future, we will make separate notices accordingly. For your information, Cookies are small computer files that can be stored in web surfers’ computers for the purposes of obtaining configuration information and analysing web surfers’ viewing habits. They can save you from registering again when re-visiting a website and are commonly used to track your preferences in relation to the subject matter of the website. You may refuse to accept Cookies (by modifying the relevant Internet options or browsing preferences of your computer system), but you may not be able to utilize or activate certain available functions in the COHC Website as the result.
14. The provisions of this policy may form part of the account terms and conditions and/or the agreement or arrangements that you have entered or may enter into with COHC. If any inconsistency is found, the provision of this policy shall prevail.
15. This policy is subject to change from time to time and any changes will be posted on COHC’s website at www.cohc.hk.
16. In case of discrepancies between the English and Chinese versions, the English version shall prevail.
